Our Zero-Tolerance Anti-Spam Policy

We enforce a zero tolerance policy prohibiting abuse by spamming and other unacceptable promotional activities. Sending emails to addresses gained by any means other than verified opt-in to our list will be grounds for instant termination of any facilities, memberships or accounts you may have with us.

Most autoresponders by themselves are not Spam. They are based on the verified opt-in model of email distribution. This means that your recipients must express interest in your information by sending you an email, filling out a form, making a purchase or otherwise contacting you first. In addition, all messages sent from an autoresponder accounts must have an Unsubscribe link and a Change Email Address link, so the recipient can opt-out of the list at any time. We honour each request promptly.

Users, members or affiliates of Profit Clinic-owned online systems are strictly prohibited from sending unsolicited commercial email (UCE) or SPAM from their email and autoresponder accounts, whether messages are sent direct, by third party or by any affiliate or similar agent acting on the account holder’s behalf. The Profit Clinic reserves the right to terminate the account of any user breaching this condition, without notice or compensation.

All lists used in conjunction with the services provided by The Profit Clinic must be 100% verified opt-in. We require clients to provide proof of opt-in for any or all list subscribers on demand.

This has also become the basis of legal precedent against SPAM or UCE.

Any Profit Clinic member, affiliate or user found to be involved in a SPAM/UCE campaign involving the services provided by The Profit Clinic, in any way, including flooding newsgroups, distributing messages to recipients who did not request them, or any other abuse of our system contravening UCE legislation, will be subject to the following:

  1. The account will be closed immediately, without burden of notice or compensation.
  2. The terms of our Privacy Policy will no longer apply. All relevant information will be provided to any investigating authorities, courts of law or anti-Spam organizations
  3. All information stored within your account will be confiscated, with no consideration of retrieval.

Further, you will be held accountable for any monetary damages, costs, fines, awards, penalties or losses suffered by The Profit Clinic due to your contravention of our Terms of Service and Anti-Spam policy. This may include, but is not limited to, loss of Web/Domain host, any costs incurred securing further Web/Domain hosting, and compensatory and punitive damages related to lost clients and subsequent revenues and profits.

Where other clients, members, affiliates or users of Profit Clinic services, systems or programs suffer financial losses, costs or penalties of any kind as a consequence of your actions, we reserve the right to pass on all details in our possession to enable them to pursue legal remedy for such losses against you.

The Bottom Line: Don’t even THINK about using our facilities or resources to send spam. And if you think it’s smart to spam our email accounts, here’s our legally-binding contract that comes into force with your first message:

NOTICE OF BINDING LEGAL CONTRACT FOR SENDERS OF UNSOLICITED BULK COMMERCIAL EMAIL (SPAM)

We agree to download unsolicited bulk commercial email sent by you, or by others on your behalf, to any address at this domain for a fee of US$25 per message, payable on demand. Delivery of such messages to our mail servers constitutes acceptance of this contract by you regardless of the origins of any mailing list used or the methods used to compile it or whether such messages were sent by you or by others on your behalf or whether messages downloaded under this contract are opened by us or not and you further agree to compensate us in full for all costs incurred by us in tracing you for the purpose of enforcing this contract. (You send ’em, you pay.)

No spam is sent from this domain, ever. If you receive a spam message
purporting to be from us, the alleged sender’s address is a forgery. Count on it.
